    In a suit filed Monday, Michael Jackson is seeking to prevent concert promoter Marcel Avram from proceeding with arbitration over a disputed 1999 New Year's Eve concert contract.

    Jackson and his company, MJ Company, are suing Avram and his Germany-based company, Mama Concerts and RAU, for breach of contract. The lawsuit also calls for a preliminary injunction to prevent Avram from going forth with arbitration.

    In 2003, Jackson lost a civil suit brought against him by Avram, with a Santa Maria jury awarding the concert promoter $5.3 million in damages. At the time, Avram's attorney Louis "Skip" Miller stated that his client's intended to appeal $6 million that Judge Zel Cantor had prevented the jury from considering.

    According to court papers, Jackson and Avram signed a settlement agreement in 2003, which resolved all existing and future claims connected with the concert lawsuits. Disputes regarding the agreement were to be handled in Los Angeles Superior Court as part of the settlement agreement, but Avram has decided to proceed with arbitration, a violation of the agreement, the lawsuit stated.

    "Plaintiffs Jackson and MJ Company seek this court's intervention to compel Avram to abide by the terms of the settlement agreement and to engage Plaintiff's in this forum regarding their purported right to relief," according to court papers.

    An arbitration hearing is scheduled for October 24, 2005.

    Jackson is seeking an injunction to prevent any alternate forms of dispute resolution, interest on sums awarded, and costs of the lawsuit.

    Jackson attorney Michael Bruce Abelson did not immediately comment comment on the case.
